This Week’s Independent Contractor Rule Update

On Monday, March 11, 2024, the new independent contractor rule took effect. As Littler explained, the new rule:

  • Created a six-factor “economic realities” test to determine independent contractor status under the FLSA.
  • Differs significantly from prior DOL guidance and its rule governing independent contractor relationships issued in 2021

But, you don’t have to worry! Navigator IC was updated, and any evaluations run on or after March 11, 2024, use the new rule to determine your independent contractor risk. If you would like to see if the new rule changed the outcome of any of the risk reports you generated in the past, you can follow these directions to copy an existing evaluation.

In order to implement the new rule, a few additional questions had to be added to Navigator IC. Keep this in mind when you copy existing evaluations, because there will be a few additional questions you will need to complete before submitting the copied questionnaire.
