A little while ago, we received feedback from our clients regarding the frontloading information available in the Paid Sick Leave Report in the Reference Center. After carefully reviewing this feedback, we collaborated with Littler’s paid sick leave subject matter experts to revamp the existing question “Can employers comply with the law by frontloading paid sick time?”  The discussion now specifically focuses on answering the question “Can employers avoid carryover by frontloading?” If a statute or rule expressly allows the practice of pro-rata frontloading for mid-year hires or part-time employees, this information is also included in the discussion. As a result, the salary increase that occurred on July 1, 2024, for the FLSA’s executive, administrative, and professional exemptions is no longer in place. This also means that the increase planned on January 1, 2025, will no longer take effect. Evaluations completed between 9:00 pm EST on June 17, 2024, and 6:30 pm EST November 18, 2024, had the July 1st salary threshold applied.
